Welcome to Flamingo Taylor—where bold shirts and good times come together. These Terms of Service explain the rules that apply when you visit flamingotaylor.com (the “Site”), purchase our products, communicate with us, or otherwise use our services (collectively, the “Services”).

Throughout these Terms, “Flamingo Taylor,” “we,” “us,” and “our” refer to Flamingo Taylor. “You” and “your” refer to the person accessing or using the Services.

By accessing the Site or purchasing from us, you agree to these Terms and to the policies referenced in them. If you do not agree, please do not use the Services.

1. Eligibility and authority

You must be at least the age of legal majority where you live, or have the permission and supervision of a parent or legal guardian, to use the Services or place an order.

If you use the Services on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms.

2. Store platform

Our store is hosted by Shopify, which provides the ecommerce platform that allows us to offer products and Services to you. Your use of certain Shopify features may also be governed by Shopify’s applicable terms and policies.

3. Product information

Our shirts are designed to stand out, and we want you to know what to expect before choosing your favorite. We work to present product descriptions, photographs, colors, patterns, measurements, size charts, pricing, and availability as accurately as reasonably possible. However:

● Colors may appear differently depending on your screen, device, lighting, and display settings.

● The placement of an all-over print or repeating pattern may vary slightly from one garment to another.

● Measurements and fit may vary within customary manufacturing tolerances.

● Packaging, labels, components, or minor product details may change without materially changing the product.

Please review the product description, size chart, care instructions, and available images before ordering. Product images are provided for illustration and may not show every possible variation.

4. Made-to-order products

Every Flamingo Taylor shirt starts its journey after you place your order. Our products are generally made to order specifically for the customer who purchases them, and we do not maintain traditional pre-made inventory for most items.

Because production may begin shortly after an order is submitted, requests to change or cancel an order are not guaranteed. Contact us immediately at flmgotaylor@gmail.com if you discover a problem with your order information. We will try to help when reasonably possible.

Our made-to-order process also affects return and exchange eligibility. Please review our Return, Refund & Replacement Policy before purchasing.

5. Orders and order acceptance

Submitting an order is an offer to purchase. An automated order confirmation acknowledges that we received your order, but it does not mean that we have accepted or can fulfill it.

We may refuse, limit, or cancel an order when reasonably necessary, including when:

● A product, price, promotion, or description contains an error.

● A product or production option is unavailable.

● Payment cannot be authorized or appears fraudulent.

● The order violates these Terms or applicable law.

● The order appears intended for unauthorized resale or other improper activity.

● Shipping restrictions prevent us from completing delivery.

If we cancel an order after payment has been collected, we will issue a refund to the original payment method for the canceled portion. Your financial institution may require additional time to post the refund.

We may limit quantities purchased per person, household, payment method, account, billing address, shipping address, or order.

6. Customer information and account security

You agree to provide current, complete, and accurate purchase and account information, including your email address, billing information, shipping address, and telephone number when requested.

You are responsible for reviewing order details before submitting an order and for promptly updating information when necessary. You are also responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account, except to the extent caused by our failure to use reasonable security measures.

Please notify us promptly if you believe your account or payment information has been used without authorization.

7. Prices, taxes, and payment

Prices are shown in the currency displayed on the Site and may change without notice. The price charged is the price displayed at checkout when your order is submitted, subject to correction of obvious errors.

Applicable shipping charges, sales taxes, duties, or other charges will be displayed or calculated when reasonably possible. International customers may be responsible for customs duties, import taxes, brokerage charges, or similar fees imposed by the destination country, as further explained in our Shipping Policy.

You authorize us and our payment providers to charge the payment method submitted for your order, including applicable taxes and shipping charges. You represent that you are authorized to use that payment method.

Payment information is processed through Shopify and available payment providers. Flamingo Taylor does not directly store complete payment-card numbers.

8. Promotions and discount codes

Promotions, discount codes, and special offers may be subject to separate conditions, eligibility requirements, expiration dates, product exclusions, or quantity limits. Unless expressly stated otherwise:

● Discounts cannot be combined.

● Discounts cannot be applied retroactively to completed orders.

● Promotions have no cash value.

● We may modify or end a promotion at any time before an eligible order is placed.

If promotional terms conflict with these Terms, the specific promotional terms control for that promotion.

9. Production, shipping, and delivery

Before your order takes flight, it may require production. Production and delivery timeframes are estimates and are not guaranteed arrival dates unless we expressly provide a written guarantee for a particular order.

Shipping destinations, charges, production estimates, delivery estimates, tracking, address responsibilities, international charges, delayed packages, lost packages, and packages marked delivered are governed by our Shipping Policy, which is incorporated into these Terms.

Please order early if you need an item for a vacation, birthday, holiday, event, or other specific date.

10. Returns, refunds, replacements, and exchanges

If something ruffles your feathers, we want you to know where you stand. Returns, refunds, replacements, exchanges, damaged or defective products, incorrect items, sizing issues, customer-submitted claim information, and applicable deadlines are governed by our Return, Refund & Replacement Policy, which is incorporated into these Terms.

Nothing in these Terms or our policies limits any non-waivable rights you may have under applicable consumer-protection law.

11. Care and use of products

You are responsible for following any care instructions provided with a product or displayed on the Site. Normal wear, misuse, accidents, improper washing or drying, alterations, failure to follow care instructions, and damage occurring after delivery are not manufacturing defects.

Our clothing and accessories are intended for ordinary consumer use. You are responsible for determining whether a product is appropriate for your intended use.

12. Acceptable use

You may use the Services only for lawful personal or business purposes consistent with these Terms. You may not:

● Use the Services to violate any law or the rights of another person.

● Submit false, misleading, fraudulent, or abusive orders, claims, reviews, or communications.

● Attempt to gain unauthorized access to the Site, customer accounts, systems, or networks.

● Introduce malicious code, viruses, automated scraping tools, or other technology that interferes with the Services.

● Collect or track another person’s personal information without lawful authority.

● Impersonate another person or misrepresent your identity or affiliation.

● Circumvent security, purchase limits, promotions, or access restrictions.

● Copy, reproduce, modify, distribute, sell, or exploit Site content or product artwork without permission.

● Use the Services in a way that could damage Flamingo Taylor, Shopify, our providers, or other users.

We may suspend or terminate access to the Services for conduct that violates these Terms or creates a reasonable risk of harm, fraud, liability, or disruption.

13. Intellectual property

The bold patterns, playful names, original artwork, and overall Flamingo Taylor experience are part of what makes the flock unique. The Site and its contents—including the Flamingo Taylor name, logos, product names, designs, artwork, patterns, photographs, graphics, text, videos, and site layout—are owned by or licensed to Flamingo Taylor and are protected by intellectual-property laws.

We grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Site for lawful shopping and personal use. Purchasing a product does not transfer ownership of the artwork, design, brand, or other intellectual property appearing on that product.

You may not reproduce, manufacture, print, distribute, license, create derivative works from, or commercially exploit our content or designs without prior written permission.

14. Reviews, photographs, and other customer content

If you submit a review, photograph, testimonial, comment, suggestion, or other content to us or through the Site, you represent that:

● You own the content or have permission to submit it.

● The content is accurate to the best of your knowledge.

● The content does not violate another person’s rights or applicable law.

● The content is not fraudulent, defamatory, threatening, obscene, or malicious.

You retain ownership of your content. You grant Flamingo Taylor a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt, publish, display, and share that content for operating, improving, and promoting Flamingo Taylor, including on our Site, social-media accounts, advertisements, and marketing materials. This license continues until you withdraw permission by contacting us, except where the content has already been incorporated into completed materials or where retention is legally required.

We may remove customer content that violates these Terms or is otherwise inappropriate for our Services.

15. Feedback and ideas

If you voluntarily send us an idea, suggestion, or general feedback about the business or Services, we may use it without restriction or compensation to you. This section does not transfer ownership of artwork, photographs, or other original content submitted under a separate written agreement.

16. Third-party services and links

The Services may contain links to, integrations with, or features provided by third parties, including Shopify, payment processors, production and fulfillment providers, shipping carriers, analytics providers, social-media platforms, and marketing services.

We are not responsible for third-party websites, content, products, terms, availability, or privacy practices. Your interactions with a third party may be governed by that party’s own terms and policies. A link or integration does not necessarily mean that Flamingo Taylor endorses every aspect of the third-party service.

17. Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy. By using the Services, you acknowledge that policy.

18. Errors and corrections

Information on the Site may occasionally contain typographical errors, inaccuracies, or omissions relating to product descriptions, prices, promotions, shipping charges, delivery estimates, availability, or other details.

We may correct errors and update information at any time. If a correction materially affects an order you already submitted, we will take reasonable steps to notify you and, when appropriate, offer the option to confirm or cancel the affected portion of the order.

19. Service availability and changes

We may update, modify, suspend, or discontinue any part of the Services when reasonably necessary. We do not guarantee that the Site will always be available, uninterrupted, secure, or error-free.

We are not responsible for temporary interruptions caused by maintenance, hosting issues, carrier or provider outages, cybersecurity events, natural disasters, government actions, or other circumstances beyond our reasonable control.

20. Disclaimer of warranties

To the fullest extent permitted by law, the Services and Site content are provided on an “as available” basis. Except for any express promises stated in these Terms, our published policies, or applicable product descriptions, Flamingo Taylor disclaims implied warranties to the extent the law permits, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent legally permitted. Nothing in this section limits warranties or consumer rights that cannot lawfully be waived.

21. Limitation of liability

To the fullest extent permitted by law, Flamingo Taylor and its owners, personnel, affiliates, and service providers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, including lost profits, lost data, or loss of opportunity, arising from or related to the Services or products.

To the fullest extent permitted by law, Flamingo Taylor’s total liability for a claim relating to a particular order will not exceed the amount you paid to Flamingo Taylor for that order.

These limitations do not apply to liability that cannot legally be limited or excluded, including liability arising from fraud, willful misconduct, or other matters for which applicable law prohibits limitation.

22. Indemnification

To the extent permitted by law, you agree to indemnify and hold Flamingo Taylor and its owners, personnel, affiliates, and service providers harmless from third-party claims, damages, liabilities, and reasonable costs arising from your unlawful misuse of the Services, your material breach of these Terms, or your infringement of another person’s rights.

This obligation does not apply to the extent a claim results from Flamingo Taylor’s own negligence, willful misconduct, or violation of law.

23. Governing law and disputes

These Terms are governed by the laws of the State of Louisiana, without regard to conflict-of-law principles, except where the mandatory consumer laws of your place of residence apply.

Before filing a formal claim, you and Flamingo Taylor agree to make a good-faith effort to resolve the matter by contacting the other party and allowing a reasonable opportunity to respond.

Unless applicable law requires otherwise, legal proceedings arising from these Terms or the Services must be brought in a court with proper jurisdiction located in Lafayette Parish, Louisiana.

Nothing in this section prevents either party from seeking relief in small-claims court when eligible or from exercising rights that cannot legally be waived.

24. Termination

You may stop using the Services at any time. We may suspend or terminate your access when reasonably necessary because of a violation of these Terms, suspected fraud, unlawful conduct, security risk, or harm to Flamingo Taylor, another user, or a service provider.

Termination does not affect rights and obligations that arose before termination. Provisions that by their nature should continue—including those concerning payment, intellectual property, disclaimers, liability, disputes, and indemnification—will survive.

25. Severability and waiver

If any provision of these Terms is found unenforceable, it will be limited or removed only to the minimum extent necessary, and the remaining provisions will continue in effect.

Our failure to enforce a provision is not a waiver of that provision or our right to enforce it later.

26. Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer these Terms as part of a merger, acquisition, financing, reorganization, sale of assets, or transfer of the business, subject to applicable law.

27. Entire agreement and policy order

These Terms, together with our Privacy Policy, Shipping Policy, Return, Refund & Replacement Policy, and any additional terms presented for a specific product or promotion, form the agreement between you and Flamingo Taylor concerning the Services.

If these Terms conflict with a specific product offer or promotion, the more specific terms control for that product or promotion. If these Terms conflict with the Shipping Policy or Return, Refund & Replacement Policy regarding shipping, returns, refunds, replacements, or exchanges, the applicable specific policy controls.

28. Changes to these Terms

We may update these Terms to reflect changes in our Services, business practices, technology, or legal obligations. The revised Terms will be posted on the Site with an updated effective or “last updated” date.

Changes apply prospectively from the posted date unless the law permits or requires otherwise. Your continued use of the Services after revised Terms become effective constitutes acceptance of the revised Terms.
